Understanding California Proposition 65
Overview
Proposition 65 regulates substances listed by California as causing cancer or birth defects or other reproductive harm in two ways. The first regulatory arm of Proposition 65 prohibits businesses from knowingly discharging listed substances into drinking water sources, or onto land where the substances can pass into drinking water sources. The second regulatory arm of Proposition 65 prohibits businesses from knowingly exposing individuals to listed substances without providing a clear and reasonable warning. Cal Prop 65 states: "No person in the course of doing business shall knowingly and intentionally expose any individual to a chemical known to the state to cause cancer or reproductive toxicity without first giving clear and reasonable warning to such individual." California Proposition 65 is changing every month. With over 400 judgments to date, manufacturers, distributors and retailers need to know how this effects their products. About the Speakers
Leeton Lee - Mr. Lee has over 15 years of experience in product safety compliance, quality assurance, risk management and safety recalls in the key areas of toys, children's products, premiums, promotional products, apparel, and other consumer products. He has many years of experience as an in-house legal counsel for well-known toy and consumer products companies, along with having established and supervised the companies' in-house product compliance, safety, and quality assurance departments. Paul Rosenlund - Partner at Duane Morris in San Francisco, who advises and represents business clients in a variety of areas, including products liability litigation and risk management; toxic torts and California Proposition 65; unfair competition and commercial disputes, including international arbitration; trade secrets; trademark, copyright and patent litigation; and class actions, including consumer protection, antitrust and unfair lending issues. He serves as national or regional counsel for manufacturers and distributors and has handled dozens of jury trials around the country. He also counsels manufacturers, importers and retailers in trade regulation, franchise and distribution issues, resale price maintenance, and regarding product safety, recalls and compliance matters involving the U.S. Consumer Product Safety Commission (CPSC) and its counterparts in other countries. Many of his clients are European or Asian manufacturers, investors or insurers who benefit from national or international coordination of their legal affairs.
